Conducting a Trademark Search Prior to Launching a New Brand Can Save You Money and Headaches
Are you launching a business or a new brand?
Having a trademark search performed first, prior to launching the new brand or business, is critical and can save you a lot of time, money and inconvenience down the road. It is often the case that a business receives a cease and desist letter from a competitor claiming trademark infringement. This can happen soon after launching, or years down the road after your business has already branded its products and equipment with the trademark, and after your business has already built goodwill and brand recognition through the trademark.
If your trademark is confusingly similar to a competitor’s existing trademark, then you may need to re-brand to avoid litigation, which is costly and time-consuming. In addition, changing trademarks on products, product packaging, uniforms, signage, websites and social media results in disruption to your business and requires re-building brand recognition and goodwill in the new trademark.
